1、Definition of NVOCC
Non-Vessel Owning Common Carrier(NVOCC) which is technical terminology, is one type of sea freight forwarders. There is no definite concept of Non-Vessel Operating Common Carrier in related Chinese Maritime Law yet. Though there is no direct definition of Non-Vessel Operating Common Carrier fin Regulations in International Maritime Transportation implemented on January 1, 2002, the concept of “Non-Vessel Operating Business” is regulated while manager of Non-Vessel Operating Business’s legal status is confirmed. “Non-Vessel Operating Business” means that manager of Non-Vessel Operating Business accepts shipper’ cargo as carriers, to sign own bill of landing or other transportation documents, collect freight from shipper through international vessel transportation manager to accomplish international maritime freight transportation and undertake carrier’s responsibilities in international maritime transportation management activity.
2、NVOCC
Civil Law Status
According to Rules of Regulations on International Maritime Transportation, NVOCC’s Law Status can be listed as follow:
First, NVOCC’s legal status is common carrier that has the right to conclude transportation contract. When accepting shipper’s cargo, he should sign bill of landing or related transportation documents: Second, due to NVOCC doesn’t own any conveyance; he is only able to finish the transportation contract through maritime carrier. NVOCC is known as contract carrier instead of actual carrier. Third, since NVOCC is to sign the bill of landing or related transportation documents, he is responsible for the freight transportation in the contract. Fourth, NVOCC has double identity. To shipper, he is the carrier or transportation manger. But to actual carrier, he is the shipper.
3、NVOCC Business Range:
Non-Vessel Operating Business includes:
a) Accept cargo as carriers or sign international transportation contract with shippers
b) Sign bill of landing or related transportation documents
c) Book cargo space or consign freight from maritime or inland transportation carriers
d) Charge freight and other fees of service contract
e) Pay for the fees of “ port to port delivery” or Multimodal Transport
